Welcome to GolfNex. These Terms of Service ("Terms") govern your access to and use of the GolfNex mobile application, website, and related services (collectively, the "Service") provided by GolfNex LLC ("GolfNex," "we," "us," "our"), an Illinois limited liability company.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

We may suspend or terminate accounts that violate these Terms, abuse the Service, or otherwise pose risk to other users or to us.
The Service allows you to reserve simulator bays, tee times, and related golf services at participating facilities. Bookings are subject to availability and to the policies of the facility you are booking with.
Payments are processed by Stripe, Inc. on behalf of GolfNex LLC. By making a booking, you authorize us to charge the payment method you provide. All prices are shown in U.S. dollars unless otherwise stated.
Cancellation and refund policies are set by each individual facility. The applicable policy will be displayed at the time of booking. By confirming a booking, you agree to the facility's cancellation policy.
If you do not show up for a booking, you may be charged a no-show fee in accordance with the facility's policy.
If you believe a charge was made in error, contact us at naren@golfnex.com within 30 days of the charge. We will work with you and the facility to resolve the dispute.

Some features of the Service include phone-based access to physical facilities, including door unlock and bay control. By using these features, you agree to:
You are responsible for any damage caused by you or guests using your access.
The Service may allow you to submit content such as profile information, scores, comments, or feedback. You retain ownership of your content but grant GolfNex a non-exclusive, royalty-free, worldwide license to host, store, display, and use that content as needed to operate the Service.
You are responsible for the content you submit and represent that you have the right to do so.
The GolfNex name, logo, App, website, and all related software, content, and materials are owned by GolfNex LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service except as expressly permitted.
The Service integrates with third-party providers such as Stripe (payments), Google (sign-in and analytics), Apple (sign-in), Sentry (error monitoring), and TrackMan (simulator data, where applicable). Your use of those services is also subject to their respective terms. We are not responsible for the practices, content, or availability of third-party services.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We make no warranty regarding the accuracy, reliability, or completeness of any data displayed in the Service, including handicaps, shot statistics, GPS distances, or facility availability.
Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amount you paid GolfNex in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless GolfNex LLC and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.
You may stop using the Service and delete your account at any time by contacting naren@golfnex.com.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, abused the Service, or for any other reason at our discretion. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will survive.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. We will post the updated Terms at this URL with a new "Last updated" date. If we make material changes, we will notify you in the App or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GolfNex LLC regarding the Service and supersede any prior agreements.
